Neill Campbell to  Aaron Higginbotham - October 3, 1768

 

This Indenture made the third day of October one thousand seven hundred and sixty eight between Neill Campbell of the County of Albemarle of the one part and Aaron Higginbotham of the County of Amherst of the other part.

Witnesseth that the said Neill Campbell for and in consideration of the sum of one hundred and ten pounds curr. money to him in hand paid to him by the said Aaron Higginbotham the receipt whereof he doth hereby acknowledge hath granted, bargained and sold and by these presents doth grant, bargain and sell alien endorse and confirm unto the said Aaron Higginbotham and to his heirs and assigns forever, one certain tract or parcel of land containing three hundred and ninety acres more or less lying and being in the County of Amherst on Thrashers Creek, being the same land the said Neill Campbell lately purchased of John Parks per Deed recorded to him in Amherst Court and bounded as followeth, viz. Beginning at pointers and running thence on new lines north six degrees east fifty four poles to a forked dogwood, north twenty degrees west fifty two poles to a white oak, north ten degrees west two hundred and eighty four poles to a chestnut oak, south seventy six degrees east crossing Thrashers Creek to pointers, South ten degrees east three hundred and eighty three poles to a white oak and north seventy six degrees west crossing Thrashers Creek one hundred and ninety one poles to the beginning, together with all houses, orchards, gardens, water, watercourses, advantages and all other appurtenances to the same belonging or anyways appertaining, and the revision and revisions, remains or and remainders of every part and parcel thereof to have and to hold the said tract or parcel of land with their and every of their appurtenances unto the said Aaron Higginbotham his heirs and assigns to the only proper use and behoof of him the said Aaron Higginbotham his heirs and assigns forever, and the said Neill Campbell for himself, for himself his heirs, executors and administrators the aforesaid land and premises with their and every of their appurtenances unto the said Aaron Higginbotham his heirs and assigns, against the Claim of Demand of him the said Neill Campbell his heirs, executors and administrators and against all other person and persons whatsoever shall and will warrant and forever defend. In witness whereof the said Neill Campbell hath hereunto set his hand and seal the day month and year aforesaid.

Memorandum that on the third day of October one thousand seven hundred and sixty eight quiet and peaceable possession and seisen was had and taken of the land and premises within mentioned by the aforesaid Neill Campbell and by him delivered to the within named Aaron Higginbotham according to the form and effect of the within written Indenture.

Amherst County, Oct. 3, 1768. Then received of Aaron Higginbotham within named one hundred and six pounds current money of Virginia it being in full of the consideration money in this Deed mentioned.

At a Court held for Amherst County at the Courthouse the third day of October 1768. This Indenture and the Memorandum and receipt endorsed were acknowledged by Neil Campbell to be his Act of Deed and ordered to be recorded.
