Aaron Higginbotham to Neill Campbell - October 3, 1768

 

This Indenture made the third day of October in the year of our Lord one thousand seven hundred and sixty eight between Aaron Higginbotham and Clara his wife of the County of Amherst of the one part and Neill Campbell of the County of Albemarle of the other part. Witnesseth that the said Aaron Higginbotham and Clara his wife for and in consideration of the sum of one hundred and fifty pounds current money to them in hand paid by the said Neill Campbell the receipt whereof they do hereby acknowledge have given granted bargained and sold by these presents do give grant bargain and sell alien endorse and confirm unto the said Neill Campbell and to his heirs and assigns forever the following three tracts or parcels of land lying and being in the County of Amherst on both sides the south fork of Buffalo River containing in the whole four hundred and eighty nine acres be the same more or less, the first or upper tract containing one hundred and ninety acres by Patent in the said Higginbotham name bearing date at Williamsburg the thirteenth day of August one thousand seven hundred and sixty three, the second or middle tract containing two hundred acres by Patent granted as above bearing date at Williamsburg the third day of March one thousand seven hundred and sixty, the third or lower tract containing ninety nine acres by Patent granted as aforesaid bearing date at Williamsburg the twenty sixth day of July one thousand seven hundred and sixty five together with all houses, orchards, fences, gardens, waters and watercourses, ways, woods, underwoods profits, commodities and advantages and all other appurtenances whatsoever belonging to the same or any ways appertaining. To have and to hold the aforesaid three tracts or parcels together with the aforesaid premises and every part and parcel thereof with their and every of their appurtenances unto the said Neill Campbell his heirs and assigns to the only proper use and behoof of him the said Neill Campbell his heirs and assigns forever. And the said Aaron Higginbotham and Clara his wife for themselves their heirs and assigns executors and administrators doth covenant and agree to and with the said Neill Campbell his heirs and assigns that the said Aaron Higginbotham and Clara his wife their heirs and assigns the above mentioned lands and premises with their and every of their appurtenances unto the said Neill Campbell his heirs and assigns against them the said Aaron Higginbotham and Clara his wife their heirs executors and administrators and against all other persons whatsoever shall and will warrant and forever defend. In witness whereof the said Aaron Higginbotham and Clara his wife hath hereunto set their hands and seals the day month and year aforesaid.

The word (date) interlined between the twenty fourth and twenty fifth lines of the first side and the word (twenty) interlined between the twenty ninth and thirtieth lines of the same side adverted to before the signing of this deed.

Memorandum that on the third day of October one thousand seven hundred and sixty eight quiet and peaceable possession and leisin of the land and premises within mentioned was had and taken by the said Aaron Higginbotham and Clara his wife and by them delivered to the within named Neill Campbell according to the form and effect of the within written Indenture.

Albemarle County Oct. 3, 1768. Then received of the within named Neill Campbell one hundred and fifty pounds Virginia currency it being in full of the consideration money in this Deed mentioned.

At a Court held for Amherst County at the Courthouse the third day of October 1768 this Indenture and the Memorandum and receipt endorsed were acknowledged by Aaron Higginbotham and Clara his wife and ordered to be recorded, and the said Clara being first privily examined as the law directs voluntarily relinquished her right of Dower in the Estate conveyed in this Indenture.
