Aaron Higginbotham to Church Wardens - September 6, 1762

 

This Indenture made this sixth day of September in the year of our Lord one thousand seven hundred and sixty two between Aaron Higginbotham & Clary, his wife of the County of Amherst of the one part and William Cabell Jun. and Cornelius Thomas, Church Wardens of the Parish of Amherst in the County of Amherst of the other part. Witnesseth that the said Aaron Higginbotham & Clary his wife for and in consideration of the sum of one hundred and twenty pounds current money of Virginia to them in hand paid by the said William Cabell Jun. and Cornelius Thomas the receipt thereof the said Aaron Higginbotham and Clary his wife doth hereby acknowledge, and of every part and parcel thereof doth clearly acquit, exonerate and discharge the said William Cabell Jun. and Cornelius Thomas, Church Wardens as aforesaid & their sucessors, hath granted, bargained & sold, aliened & confirmed, and by these presents doth grant, bargain & sell alien & confirm unto the said William Cabelle, Jun. and Cornelius Thomas, Church Wardens of the Parish of Amherst & their successors one certain tract or parcel of land containing two hundred and four acres (as and for a glebe for the said Parish of Amherst) lying and being in the County of Amherst on the branches of Higginbotham’s Old Mill Creek being part of a tract formerly granted to Col. George Braxton late of the County of King and Queen and by him conveyed to Moses Higginbotham, and by him to the said Aaron Higginbotham, and is bounded as followeth (to wit): Beginning at a Red Oak in Braxton’s line and with his lines south fifty one degrees west eighty six poles to a Red oak saplin, & south ten degrees east one hundred and seventy five poles to pointers, new lines, north fifty five & a half degrees east two hundred and twenty three poles to pointers on the south side of the Mill Creek, north thirty three degrees east forty four poles to pointers, north fifty five degrees west one hundred and eighty seven poles to a White Oak, and south twenty six degrees west forty two poles to the first station, and now in the possession of the said William Cabell, Jun. & Cornelius Thomas with all houses, ways, easements & advantages whatsoever to the said land & premises belonging or appertaining, and also all the estate, right title, interest claim and demand whatsoever of him the said Aaron Higginbotham & Clary his wife of in and to the same. To have and to hold the said land and premises, with the appurtenances unto the said William Cabell, Jun. & Cornelius Thomas, Church Wardens of the Parish of Amherst and their successors forever, and the said Aaron Higginbotham & his heirs the said land and premises above mentioned with the appurtenances to the said William Cabell, Jun. & Cornelius Thomas, Church Wardens as aforesaid and their successors, against him the said Aaron Higginbotham and his heirs & all other persons will warrant & forever defend by these presents. In witness whereof the said Aaron Higginbotham & Clary his wife hath hereunto set their hands and seals.

At a Court held for Amherst County at the Court House the 6th day Sept. 1762.

Aaron Higginbotham and Clary his wife (she being first privately examined & voluntarily assenting thereto) acknowledged this Deed indented with the receipt thereon endorsed to William Cabell, Jun. & Cornelius Thomas to be their Acct. & Deed and ordered to be recorded.
