In the presence of God Almighty
I Kuihn Higginbotham of Amherst County Virginia being of sound mind, and considering the uncertainty of life do therefore make and declare this to be my last Will and Testament. That is say First after all my lawful debts are paid the residue of my estate both real and personal I give and bequeath to my Wife Ada Burch Higginbotham during the time of her natural life and after her death to be equally divided between my two daughters or their heirs.
Likewise I make constitute and appoint my said Wife to be Executrix of this my last will and testament without bond or security witness whereof I hereunto subscribe my name and affix my signature this Day 23 of March 1906.
Kuihn Higginbotham {Seal}
Virginia:
In the Clerk’s Office of the Circuit Court of Amherst County, December 9th, 1912.
A paper writing, bearing date the 23rd day of March, 1906, purporting to be the last will and testament of Kuihn Higginbotham, deceased, was this day produced before me in said office and offered for probate, and there being no subscribing witnesses thereto, A. P. Burks and J. W. Coffey being first duly sworn that they were well acquainted with the hand writing of the said decedent and verily believed that the said writing and the name thereto subscribed to be wholly written by the said decedent’s own hand: Whereupon the said writing is admitted to probate and ordered to be recorded as the true last will and testament of the said Kuihn Higginbotham, deceased.
And on the motion of Ada Burch Higginbotham, who is appointed by said will as Executrix thereof, and who made oath thereto as required by law, and entered into and acknowledged a bond in the penalty of Fifteen Hundred Dollars (without security, security being waived by the provisions of said will), which is ordered to be recorded, certificate is granted her for obtaining a probate of the said will in due form.
Teste: W. E. Sandidge, Clerk.
